Multiple violated contracts: Lerie Taylor, of San Diego, California and arbitrations he forfeited

This posting concerns three arbitrations involving Lerie Taylor with three different employers on the vWorker site from October 8, 2009 to October 20, 2009. They are labeled as "Arbitration #1 ", "Arbitration #2 ", and "Arbitration #3".


Arbitration 1

Allegation summary:
The worker (Lerie Taylor of San Diego, California) alleged that the work was 100% complete so he should be paid. The employer (bbassett of San Francisco, California) alleged that the work was incomplete and that Lerie Taylor sent “rude emails every minute for hours on some sort of autopilot.” 


Arbitration summary: The worker, Lerie Taylor, initiated arbitration to get paid, because he alleged the work was 100% complete. The employer, bbassett, disputed Lerie Taylor’s allegation and alleged that Lerie Taylor sent “rude emails every minute for hours on some sort of autopilot.” The employer and Lerie Taylor exchanged communication.

The arbitrator warned both parties about fighting in arbitration, and reminded bbassett to respond with the required information. bbassett completed a flaw list to document what was allegedly incorrect or missing from the deliverables. The arbitrator asked Lerie Taylor to respond to the allegations in the flaw list, so the technical arbitrator would have Lerie Taylor’s side of the story.

Lerie Taylor refused to complete the flaw list and said, “I don't have time for this arbitration crap, as I have already stated before in previous messages. If i get a bad rating, I really don't care, I can always create a new account....” The arbitrator reminded Lerie Taylor that the only thing he needed to do was respond to the flaw list. The arbitrator reminded Lerie Taylor that he needed to cooperate in arbitration; otherwise he would forfeit the arbitration. The arbitrator reminded Lerie Taylor that he should not create any new accounts, as that was a violation of the legal agreement.

Lerie Taylor closed his account before the arbitration was resolved. The arbitration was closed in favor of bbassett.

vWorker could not confirm or deny that the employer was email bombed. However, recently after closing out another account that Lerie Taylor created on the vWorker site, we were also email bombed (receiving thousands of emails) from Lerie Taylor’s account.

Arbitration 2

Allegation summary:
The employer (AshanPD of Apple Valley, California) alleged that the worker (Lerie Taylor of San Diego, California) said he was unable to continue the project.

Arbitration summary:
The employer, AshanPD, initiated arbitration and alleged that the worker, Lerie Taylor, said he was unable to continue the project. Lerie Taylor confirmed that the allegation was correct.

The arbitrator offered AshanPD and Lerie Taylor two possible options (self-mediation or formal arbitration) to close the arbitration. AshanPDr and Lerie Taylor didn’t agree on a resolution for the arbitration. As a result, the arbitrator started the process of formal arbitration to determine what happened in the project.

vWorker is obligated to future employers and workers of the site to document what happened. If a worker is at fault, it would be unethical to simply “cover up” the knowledge of it and possibly cause another employer to run into the same problem. The same is true in the reverse situation, when an employer is at fault.

The arbitrator reviewed the information and the private replies. The arbitrator informed Lerie Taylor that if he refused to complete the project, he would be at fault for breaking his contract. The arbitrator asked Lerie Taylor to confirm if he wanted to break his contract. Lerie Taylor did not answer the arbitrator's question.

AshanPD and Lerie Taylor exchanged communication about the project. The arbitrator asked Lerie Taylor to confirm his choice. Lerie Taylor closed his account before the arbitration was resolved. The arbitration was closed in favor of AshanPD.

Arbitration 3

Allegation summary:
The employer (c0rey of New York, New York) alleged that the worker (Lerie Taylor of San Diego, California) told him that he didn’t want to finish the project.

Arbitration summary:
The worker, Lerie Taylor, initiated a request to cancel the project within 24 hours of bid acceptance. vWorker allows a worker to cancel the bid acceptance within 24 hours of acceptance if the worker has a legitimate reason. Since Lerie Taylor had already started working, the project was put into arbitration to find out what happened.

Lerie Taylor indicated that he wanted to continue working on the project, since the deadline was moved to Sunday. Once the deadline passed, the employer, c0rey, asked to cancel the project because Lerie Taylor didn’t want to finish the project. Lerie Taylor agreed.
